This document must be read in conjunction with the Terms and Conditions for Use of this Website.

  1. Sellers are free to adopt their own policies, provided that these policies meet at least the minimum standards of the NABAY.COM policies.
  2. If a Seller does not adopt and publish its specific policies, the NABAY.COM policies shall apply by default.
  3. In the event of contradiction or conflict between the Seller’s policies and the NABAY.COM policies, the latter shall prevail.
B.    NABAY.COM's Fees 

  • Changes to our Fees are effective after NABAY.COM provides you with at least fourteen (14) days' notice of the changes by posting the changes on NABAY.COM. However, NABAY.COM may choose to temporarily change NABAY.COM's Fees for promotional events (for example, free listing days) and such changes are effective when NABAY.COM posts the temporary promotional event on NABAY.COM.
  • NABAY.COM may, at NABAY.COM's sole discretion, change some or all of NABAY.COM's services at any time. In the event NABAY.COM introduces a new service, the fees for that service are effective at the launch of the service. Unless otherwise stated, all fees are quoted in U.S. Dollars (USD).
  • NABAY.COM requires all Seller accounts to provide a credit or debit card for the purposes of verification of their identity, and for payment of fees and services rendered. You will be requested to update the card data upon expiry or cancellation of the card originally provided.
  • You are responsible for paying all fees associated with using NABAY.COM's services and NABAY.COM and all applicable taxes. If you owe any outstanding amounts on any settlement cycle date, NABAY.COM reserves the right to deduct such amount from any amounts held by NABAY.COM for your account. Recurring fees will be settled by automatic deduction.
C.    Listing Description: You must be legally able to sell the item(s) you list for sale on the Website. You must describe your item and all terms of sale on the listing page. Your listings may only include text descriptions, graphics, pictures and other content relevant to the sale of that item. Each listing must accurately and completely describe the item/items for sale in that listing. If the "in stock" quantity is more than one, all items in that listing must be identical.

D.    Binding Sale: All sales are binding. If you, as a Seller, receive a purchase request (order) you are obligated to complete the transaction with the Buyer in a prompt manner, unless there is an exceptional circumstance, such as: (a) the Buyer fails to meet the terms of your listing (such as payment method), or (b) you cannot authenticate the Buyer's identity.

E.    Termination: Without limiting any other remedies, NABAY.COM, without notice, may suspend or terminate your account/store if NABAY.COM suspects, in its sole discretion, that you have violated any of NABAY.COM's policies set out in these Terms and Conditions or any other policy documents or community guidelines, or you have engaged in an improper or fraudulent activity in any manner on the NABAY.COM platform. If NABAY.COM terminates a listing or your account, if you close your account, or if the payment of your Seller fees cannot be completed for any reason, you remain obligated to pay NABAY.COM for all unpaid fees plus any penalties, if applicable. If the seller's account is not paid in full and becomes past due, NABAY.COM reserves the right to attempt to collect past due fees by charging the Seller's card on file. The Seller risks additional penalties such as the suspension of privileges and/or termination of the account and other collection mechanisms (including retaining collection agencies and legal counsel). If you have a question or wish to dispute a charge, contact NABAY.COM admin.

F.    Manipulation: The price stated in each NABAY.COM Item Description must be an accurate representation of the sale. Manipulation refers to activities whereby the price no longer accurately represents the monetary value of the transaction. For example manipulative activities include, but are not limited to, intentionally stating one price in the Item Description but charging a higher price to the Buyer, altering the item's price prior to a sale for the purpose of avoiding NABAY.COM transaction fees, and hacking into another's account and altering prices. Neither Buyer nor Seller, may manipulate the price of any item for any reason.

G.    The refund/replacement policy of each Seller must allow for a minimum of 15 days from the date of receipt of the item by the Buyer.
